Maguindanao 2008 COA Audit 6

. Value for Money Audit:
A Value for Money Audit was conducted on the Twenty Percent (20%) Economic Development Fund of the Province Of Maguindanao for the year ended December 31, 2008, pursuant to COA Resolution No. 2006-002, dated 31, January 2006; Re-Conduct of Comprehensive Audits by the Offices of the Commission, and in accordance with the audit thrust of the local government unit.
Pursuant to the said COA Resolution, Auditors shall conduct a compliance as well as Performance or Value for Money (VFM) audits, complementary to their financial audit under the RBAA.
Among others, the objectives of the Value for Money (VFM) Audit is to determine whether infrastructure projects funded through the 20% Development fund are clearly defined and implemented in accordance with the goals and objectives of the LGU and in compliance with existing guidelines of regulatory bodies; to ascertain whether the projects were implemented as planned and in accordance with the performance criteria/ standards set by the LGU; and to determine whether the construction of new and rehabilitation of existing roads and bridges resulted to easy transport of products, lesser transportation cost, accessibility of people going to and from places, reduced travel time and eventually resulted to better/improved living and economic condition of the people.
Finding:
A. Favorable Observation
Based on the accomplishment report submitted as of December 31, 2008,the Province of Maguindanao were able to complete 100% the 38 items of different projects funded from the twenty percent (20%) Economic Development Fund.
Pursuant to the Joint Memorandum Circular No. 1 of the DILG & DBM, dated September 20, 2005, which reads in part:
General Policies:
2.1 In accordance with Section 287 of the Local Government Code, every LGU shall appropriate in its annual budget no less than twenty percent (20%) of its annual internal revenue allotment for development projects.
2.3 All projects to be funded shall:
2.3.1 Contribute to the attainment of desirable socio-economic development and environmental management outcomes;

3.2 Economic Development
3.2.3 Construction/rehabilitation of farm to market roads
3.2.4 Construction/rehabilitation of local roads or bridges
A review made on the Annual Performance Budget for CY 2008 of the Province of Maguindanao, an amount of P 90,254,222.40, which is computed at 20% of the estimated Internal Revenue Allotment (IRA) of P90,254,222.40 were appropriated for funding the Priority Development projects of the LGU (See Annex P).
Out of this amount, and based on the accomplishment reports submitted as of December 31, 2008, the Provincial Government of Maguindanao had completed 100% all the 38 items of different projects, comprising rehabilitation of various provincial and barangay roads, in accordance with the program of works, at a total cost of P104,240,837.16, or exceeding the estimate of P90,254,222.40 by P13,986,614.76 (See Annexes R1-R2). These projects were implemented by administration as approved by various Sanggunian Panlalawigan Resolutions of the Provincial Government of Maguindanao.
However, due to the existing armed conflict in most of the municipalities in the Province of Maguindanao and due to limited manpower and time constraints, we were only able to conduct an ocular inspections only on the following selected projects, such as:
1. Rehabilitation of Bagong Farm to Market Road (FMR), Shariff Aguak, Maguindanao, costing P2,721,027.98;
2. Rehabilitation of Bagong – Timabangan Farm to Market Road , Shariff Aguak, Maguindanao, costing P 2,333,119.38;
3. Rehabilitation of Barangay Road – Mamasapano, Maguindanao, costing P3,462,072.12;
4. Rehabilitation of Matagabong Farm to Market Road, Ampatuan, Maguindanao, costing P 1,1958,282.06;
5. Rehabilitation of Maganoy – Lebak Provincial Road, Shariff Aguak, Maguindanao, costing P2,672,181.24;
6. Rehabilitation of Meta – Talibarok Road, Shariff Aguak, Maguindanao, costing P2,554,290.68;
7. Rehabilitation of Mapayag – Talitay Provincial Road, Datu Anggal Midtimbang, Maguindanao, costing P 5,827,503.02; and
8. Rehabilitation of Timbangan – Tapekan Road, Shariff Aguak, Maguindanao, costing, P2,338,119.38.
During the ocular inspection made on the said projects, we have observed that the roads are well maintained and passable to any type of motor vehicles which transport passengers and farm products such as corn, banana, palay, copra and similar other products from the farm to the markets in Shariff Aguak and neighboring municipalities. It also contributes to the reduced travel time for commuters and accordingly, helps improve the living condition of the people, especially farmers residing in the locality, because of the much higher cost of farm products sold in the markets than when bought in the farm by buyers and middlemen.
B.
Findings and Recommendations:
Finding:
1. Due to the non submission of the Calendar Year (CY) 2008 Annual Investment Plan of the Auditee by the Provincial Planning Development Office, we were not able to ascertain the relevance and necessity of the projects in terms of the overall Annual Investment Plan and on the priorities and needs of the constituents through the Local Development Council.
Pursuant to the Joint Memorandum Circular No. 1 of the DILG & DBM, dated September 20, 2005, which reads in part:
General Policies
2.2 The twenty percent (20%) economic development fund shall be utilized to finance the priority projects, as embodied in the duly approved local development plan that directly support the Medium-Term Philippine Development Plan and the Medium-Term Public Investment Program.
One objective of the Value for Money Audit is to ascertain the relevance and necessity of the projects in terms of the overall Annual Investment Plan and on the priorities and needs of the constituents through the Local Development Council. The Annual Investment Plan will serve as one of the criteria in determining whether the infrastructure projects implemented by the Auditee were the one approved by the LGU for implementation for the year and whether the approved projects are among the identified priorities of the LGU based on the objective set.
In this regard, the Office of the Audit Team Leader, Provincial Accounts, had sent communications to the Provincial Planning Development Office for the submission of the Annual Investment Plan of the agency for CY 2008 and other reports, dated January 12, 2009, (See Annex I). This is in line with the Value for Money (VFM) Audit on twenty percent (20%) economic development fund for CY 2008 on all provinces and cities nationwide, as one of the audit thrust of the local government sector of the Commission on Audit.
However, our communication letters were not officially responded to by the office concerned. According to the PPDO, their office were still in the process of completing the Annual Investment Plan for CY 2008. Thus, we were not able to ascertain the relevance and necessity of the projects in terms of the AIP and on the priorities and needs of the constituents through the Local Development Council.
They assured us however, that as soon as it is completed, though already delayed, copies of which will be provided to our office.
This is a reiteration of the prior year finding which were not complied to by management.
Recommendation forTawi-tawi Government:
The Provincial Planning Development Office should prepare the Annual Investment Plan (AIP) of the Auditee on time, in order to ascertain the relevance and necessity of the projects in terms of the AIP and on the priorities and needs of the constituents through the Local Development Council, and whether the approved projects were among the identified priorities of the LGU based on the objectives set. Copy of the AIP should be furnished the Office of the Auditor, for our reference and guidance in the conduct of the VFM audit, and for rendering appropriate management advisory services on time.

5. Supplies and materials procured by the auditee totaling to P4,532,553.00 were charged outright to an Office Supplies Expenses account, instead of recording it to an inventory account, in violation to the New Government Accounting System (NGAS).
One of the basic feature of the New Government Accounting System (NGAS) is the use of the perpetual inventory of supplies and materials, which reads:
“Supplies and materials purchased for inventory purpose shall be recorded using the perpetual inventory system. Regular purchases shall be coursed through the inventory account and issuances thereof shall be recorded as they take place except those purchased out of petty cash fund which shall be for immediate use and not for stock. Such case shall be charged immediately to the appropriate expense account.”
Based on the analysis of the financial statements submitted by the accounting office as of the end of the year, a total amount of office supplies and materials procured by the auditee and charged outright to an office supplies expense account totaled to P 4,532,553.00, breakdown of which are as follows:

An analysis made on the trial balances on general fund during the whole year showed the following balances on the Inventory account:

As can be gleaned on the extracts of the balances of the general ledger account, there was no credit balances on the Office Supplies Inventory Account. Had the accounting office actually used the Perpetual Inventory Method, all supplies and materials acquisitions by the auditee should had been a debit to Office Supplies Inventory and issuances of supplies and materials should reflect a credit to Office Supplies Inventory.
However, that is not the case as reflected in the general ledger for Office Supplies Inventory, which lead us to conclude that the auditee does not actually make use of the perpetual inventory method as required under NGAS.
Verification of stock cards on office supplies showed that the account is not properly maintained and updated, as not all acquisitions and issuances of office supplies were not regularly monitored and recorded. The stock card shall be properly maintained at the supply and property unit for each item in stock and physical inventory of supplies shall be reconciled quarterly with the stock card and any discrepancies shall be immediately verified and adjusted.
Dialogue made with the Provincial Accountant disclosed that the use of the expense account on supplies and materials acquisitions were due to the fact that there was no actual stockroom to deposit the stocks and the usual procedure is to deliver most of the stocks to the requisitioning office, hence the difficulty in assessing the actual inventory on hand at the end of each month.
Recommendation for Tawi-tawi Government:
The Provincial Accountant should record the supplies and materials acquisitions of the auditee using the perpetual Inventory Method as required under the New Government Accounting System (NGAS). This is done by debiting the Office Supplies Inventory Account for all receipts of supplies and materials. Any issuances of supplies and materials should be made thru a report to be submitted on a monthly basis to the accounting office by the supplies and materials unit of the Provincial General Service Office. In which case the entry should be a debit to Office Supplies Expense and a credit to Office Supplies Inventory.

4. An outstanding payables due to different government agencies such as BIR, GSIS, PAG-IBIG and PHILHEALTH totaling to P 7,088,625.70 remained unsettled as at year-end, in violation to Section 6 (a) of PD 1146.
Pursuant to Section 6 (a) of PD 1146, compulsory deductions made from the monthly salaries of employees such as GSIS, Pag-ibig and Medicare premiums and contributions and the like should be remitted to the agencies concerned within the first ten (10) days of each calendar month following the month to which the contribution applies.
Based on the review made on the year end Balance Sheet submitted by the Provincial Accountant, the auditee had an unsettled payables to different government agencies such as:

Revenue regulations require that taxes withheld from contractors and suppliers shall be remitted to the Bureau of Internal Revenue (BIR) within ten (10) days following the close of the calendar months during which the withholding was made.
Further, accounting and auditing rules and regulations requires that GSIS, PAG-IBIG and PHILHEALTH premiums, contributions, loan repayments and similar other obligations should be zeroed out or fully settled by every governments units concerned at every end of the year, as these obligations were covered by appropriate budget and availability of funds. Besides, delayed or non payment of monthly premiums, contributions and loan repayments to said government agencies by the auditee may result to the delay, if non availment of benefits and privileges due to the employees such as retirement benefits, salary loans, policy loans and similar other benefits.
The Provincial Accountant reasoned out that some of these unremitted obligations due to different government agencies mentioned were obligations of the past administration/s and current appropriations were not enough to cover said obligations. However, accordingly, representations were made to increase budget in the ensuing year to cover the unpaid remittances of previous administration/s.
Recommendation for Tawi-tawi Government:
The Provincial Accountant and the Provincial Treasurer should remit promptly the taxes withheld from the employees and supplier/s to the BIR and monthly premiums, contributions and loan repayments to the GSIS, PAG-IBIG, and PHILHEALTH in the total amount of P7,088,625.70, as prescribed under BIR regulations and Section 6 (a) of PD 1146, so that the employees can avail regularly on the benefits and privileges offered by the said government agencies. Supplemental budget to cover said unpaid obligations, whenever allowable under existing laws, rules and regulations, can likewise be an option.

3. The accuracy, validity and existence of the Property, Plant and Equipment valued in the Balance Sheets at a total amount of P 345,227,725.51 cannot be ascertained, due to the absence of Unit Value for all items in the submitted Year End Inventory Report by the Provincial General Services Office.
The Manual on The New Government Accounting System (NGAS) provides:
“The Physical count of property, plant and equipment by type shall be made annually and reported on the Report of Physical Count of Property, Plant and Equipment (RPCPPE)”.
The RPCPPE shall be accomplished as follows:
> Type of Property, Plant and Equipment (PPE) – Property, plant and equipment account name such as Heavy Equipment, Technical and Scientific Equipment, Motor Vehicle, Office Equipment, Furniture and Fixtures, etc.
> Date – date as of a given date
> Name of Accountable Officer
> Official Designation
> Agency/Office – branch or office where accountable officer is assigned
> Date of Assumption – first day of assumption of the duties and responsibilities as accountable officer.
> Article – type or item or article e.g. personal computer, printer, filing cabinet, etc.
> Description – brief description of the article/item e.g. acer, monitor for personal computer, Epson for printer, etc.
> Property Number – assigned property number by the Supply and Property Unit.
> Unit of Measure – e.g. piece, set, etc.
> Unit Value – cost per quantity unit
> Balance per Card – quantity of items or articles appearing in the Property, Plant and Equipment Ledger Card.
> On Hand per Count – quantity of items or articles per physical count.
> Shortage/Overage – excess of the quantity and total value of items or articles per Property, Plant and Equipment Ledger Card over that of the physical count or vice versa.
> Remarks – whereabouts, conditions and other relevant information relative to property, plant and equipment.
The Balance Sheets submitted by the Accounting Office as at Year End contained the following information on Property, Plant and Equipment:

However, a review made on the December 31, 2008 Inventory Report on Property Plant and Equipment submitted by the Office of the Provincial General Services for verification and reconciliation purposes, showed that, said report were wanting in information such as the Unit Value or cost per quantity unit of fixed assets, Balance per Card, On Hand per Count, and Shortage/Overage both for quantity and value (See Annexes N1-N4 & O1-O2). Apparently, reconciliation of the total cost of Property, Plant and Equipment (PPE) with the Inventory Report is not possible.
Verification of the property ledger cards maintained at the Provincial General Services Office disclosed that said record was not properly maintained and updated, thus, alternative audit procedures performed to ascertain the validity, existence and correctness of the PPE as presented in the Balance Sheets at a total amount of P 345,227,725.51 cannot be made. It is possible that there are some fixed assets which were either acquired by the Auditee but not recorded in the respective ledger cards or already missing or non existing but still on records.
It is likewise an indication that no reconciliation of property ledger cards maintained at the Provincial General Services Office and the property, plant and equipment ledger cards at the Office of the Provincial Accountant were not performed regularly.
This is similar to the prior year audit finding, although the amount of Property, Plant and Equipment differs than that of last year.
Recommendation for Tawi-tawi Government:
The Office of the Provincial General Services should update all the individual property ledger cards for all items acquired or disposed of by the Agency during the year. The information contained in the Report on Physical Count of Property Plant and Equipment (RPCPPE) should be properly filled up as prescribed under the NGAS. Any discrepancies between the physical count and the property cards should be reconciled and verified and adjustments shall be made on the latter. The original copy of the physical inventory report shall be submitted to the accounting office to effect any adjustments in the property, plant and equipment ledger cards and the general ledgers for any discrepancies and for the computation of depreciations, in case of acquisition or disposal.

2. The validity, existence and correctness of the Cash in Bank – LCCA amounting to P107,268,451.94 cannot be ascertained, due to the inability of the Office of the Provincial Accountant to prepare the Bank Reconciliation Statement for the whole year, in violation to COA Circular No 96-011.
COA Circular No. 96-011 dated October 2, 1996 which modifies Provincial Circular No. 19, dated June 15, 1970 delineates the responsibility for the preparation of the bank reconciliation statements to the Chief of the Accounting Department instead of the Provincial Treasurer.
Under the said Circular, the local accountant shall within ten (10) days from the receipts of the Bank Statements, reconcile the same (BS) with the General Ledger (GL) and prepare the BRS in five (5) copies distributed as follows: Original – Bank Manager; Duplicate – Provincial Auditor; Triplicate – Provincial Treasurer; Quadruplicate – COA Regional Director and Quintuplicate – Provincial Accountant.
The Accountant shall draw journal vouchers to record all valid reconciling items that require adjustments and corrections in the GL. The duplicate and quadruplicate copies of the BRS including the paid checks, original copies of debit/credit memos shall be submitted within ten (10) days from receipt after the end of each month. The Auditor shall verify the duly certified BRS and supporting schedules within ten (10) days from receipt of the same. The Auditor shall after verification, affix his signature on the BRS under the notation “VERIFIED AND FOUND CORRECT” and furnish the COA Directors concerned the duly verified BRS on a monthly basis or when there is an urgent need for the same.
The Province of Maguindanao maintains deposits for the General Fund, Trust Fund, Twenty Percent (20%) Economic Development Fund and Special Education Fund at the Philippine National Bank, Cotabato City Branch.
Based on the Balance Sheets submitted by the Office of the Provincial Accountant as at December 31, 2008, the Cash in Bank-Local Currency Account had the following balances:

However, the validity and existence of said account cannot be ascertained due to the inability of the Office of the Provincial Accountant to prepare and submit the Bank Reconciliation Statements during the twelve (12) months period for all funds.
Analysis made showed that the balances of the account on all funds were derived from the unadjusted balance of the general ledgers and no adjustments were made to reconcile the amount with the bank balances arising out of checks issued during the year and were not presented in the bank for payment, as well as debit memos, such as loan amortizations and bank charges. Items such as credit memos, and other relevant adjustments in the books were not also made. Had the Provincial Accountant prepared the Bank Reconciliation Statements on a regular basis, the discrepancies in recording reconciling items could have been avoided, and a more realistic balances of the Cash – LCCA could have been presented as at year end.
The recurring justification offered by the Provincial Accountant was the difficulty in determining the beginning balances per books and outstanding checks and other reconciling items of the previous period/s, due to the failure, accordingly, of the previous accountant/s a few years back in regularly preparing the BRS for all funds.
Consequently, the Cash in Bank – Local Currency, Current Account reflected in the consolidated Balance Sheets for CY 2008 totaling to P 3,599,003.81, may either be overstated or understated due o the non preparation by the Office of the Provincial Accountant as at year end in support of the account.
This finding is similar to that of the prior year. However, the current year amount is more material and significant than that of last year.
Recommendation forTawi-tawi Government:
The Provincial Accountant should painstakingly prepare the monthly Bank Reconciliation Statements on all funds, pursuant to COA Circular No. 96-011 dated October 2, 1996, in order to render validity and reliability on the Cash in Bank, Local Currency, Current Accounts totaling to P107,268,451.94, and submit the BRS to the Office of the Auditor within the prescribed period, for review and verification.
