PIMENTEL ASKS ANGARA TO INHIBIT FROM KOKO’S POLL PROTEST

December 3, 2010

Former Senator Aquilino “Nene” Pimentel Jr. has urged Sen. Edgardo Angara to inhibit himself from participation in the deliberations of the Senate Electoral Tribunal (SET) on the electoral protest filed by his sonAquilino “Koko” Pimentel III against Sen. Juan Miguel Zubiri.
The elder Pimentel, in his capacity as lead counsel for Koko, filed a Supplemental Motion to Disqualify Sen. Angara before the SET.
Koko Pimentel had earlier filed a Manifestation with Motion for the Disqualification of Senators Angara, Legarda, and Lapid from further sitting as members of the SET on June 24, 2010.
However, after the SET was reorganized in July 2010, Senators Angara, Legarda, and Lapid returned to the SET and continued to participate in the decision-making processes of this Tribunal.
“It is with some pain in the heart—considering that he had been a colleague of the undersigned counsel in the Senate for some time— that Senator Angara should be reminded of the officially-tallied results for the Province of Maguindanao in the 2007 national and local elections,” Pimentel said.
Pimentel attached to his motion a photocopy of the Provincial Certificate of Canvass of Votes for National Positions in the Province of Maguindanao in the 2007 national and local elections that showed Juan Miguel Zubiri garnering 195, 823 votes; Luis C. Singson, 194,241 votes; and Edgardo J. Angara, 193,990  votes.
“It is very clear and obvious therefore, that Angara is himself a beneficiary of the widespread fraud perpetrated in the Province of Maguindanao in the 2007 national and local elections that scandalously provided Protestee Zubiri with the spurious votes that he now claims entitle him to the 12th slot in the Senate,” Pimentel said.
“In the search for truth, considerations of camaraderie or even friendship must be set aside so that justice may be accorded to those who have been victimized by oppressive and powerful forces,” Pimentel added.
Pimentel said these results were officially honored by then Comelec Chairman Benjamin Abalos and the other commissioners.
The former senator pointed out: “From the official documents used by the Comelec to proclaim the winners of the 2007 senatorial elections, it looks like Protestee Zubiri may not be the only one who had stolen his way into the Senate.”
Pimentel quoted a recent newspaper editorial that said: “In the 2007 senatorial election, despite a national backlash against Arroyo and her candidates, the “voters” of Maguindanao once again trumped logic and arithmetic by allowing Arroyo’s candidate Juan Miguel Zubiri to steal into the Senate.”
Koko Pimentel had filed an electoral protest against Zubiri alleging massive irregularities in the 2007 senatorial elections. Zubiri has filed a counter-protest against Pimentel also claiming widespread irregularities in some areas, including Metro Manila.
